red tape or red herringThe Fordham Institute may be the closest thing to an honest academic broker in the contentious private school choice arena these days, and its latest report will no doubt enhance that reputation. "Red Tape or Red Herring?", released today, provides strong evidence that private schools are not averse to academic or financial oversight – a finding that runs counter to a longstanding libertarian narrative.

As Fordham president Chester Finn Jr. acknowledged in the forward: “Many proponents of private school choice — both the voucher and tax credit scholarship versions — take for granted that schools won’t participate (or shouldn’t participate) if government asks too much of them, regulates their practices, requires them to reveal closely held information and — above all — demands that they be publicly accountable for student achievement.”

The report looks at the participation rate of private schools in voucher and tax credit scholarship programs in 11 states and surveys from 241 private schools that do and don’t participate, and it finds that testing requirements are not a significant deterrent. Only a quarter of the schools ranked state-required testing as a “very” or “extremely” important factor. Among the schools not participating in voucher or scholarship programs, testing was the fifth most-cited concern – behind such issues as protection of religious activities and admission processes and government paperwork.

This is not to suggest that private schools are eager to embrace more government regulation. The report did find a modest negative correlation between the degree of regulation in a state and the rate of schools participating. But the survey is a reality check on private schools and the educators who run them. Catholic schools remain a major player in the voucher-scholarship market, in part because their mission is to serve poor children, and they also demonstrate remarkable leadership on the issue of testing and academic accountability.

In this lengthy exit interview with the Indianapolis Star, new Florida Education Commissioner Tony Bennett adds to a simmering debate, sparked last month by Gov. Rick Scott, about whether students using vouchers and tax credit scholarships to attend private schools in Florida should be required to take the same standardized tests as their public school counterparts.

By law, tax credit scholarship students in Florida are required to take a nationally norm-referenced test approved by the state Department of Education. But Bennett suggests that's not enough:

"I do believe we should assess all students who get state money. I believe that in my heart. I keep having people asking me why I believe that in Florida. For voucher schools, I’ve been asked why can’t we accept just a nationally-normed test? But if IPS said let me choose a test and let me choose a performance level to determine if its schools were any good or not, would I accept that? No. So why should I buy that from them? What makes them more creditable than IPS?"

Bennett was also asked if there's anything about expanding school choice that he fears could "in any way threaten what's good about the traditional public school system." His response:

"No. I think it will enhance it. It never worries me because I believe good schools will flourish regardless, whether they are public, private or charter. I believe it will force schools to get better. I just believe that. It’s never kept me up at night. I just believe in the force that the market creates. We’ve seen it. We’ve seen (Indianapolis Public Schools Superintendent) Dr. (Eugene) White make some pretty innovative changes. I maintain he wouldn’t have done those things."

apple marketWords such as voucher, privatization, profit and corporation are often used as weapons by individuals and groups who oppose parental empowerment and school choice. Using words as weapons is especially common during periods of significant social change - we all do it - but the practice undermines civic discourse and makes finding common ground more difficult.

“Market” is another term school choice opponents use to connote evil, but our way of life is largely based on markets, and public education is increasingly embracing market processes as customized teaching and learning become more common. Our challenge moving forward is regulating public education markets in ways that maximizes their effectiveness and efficiency.

People access products and services in one of two ways. Either their government assigns them, or they choose for themselves. In the United States, we have historically allowed citizens to choose, and this system of provider and consumer choice is a “market.”

In a goods and services market, providers decide which goods and services they want to sell, and consumers choose those they want to buy. Markets, when implemented properly, are preferable to assignment systems because they better utilize people’s knowledge, skills and motivation. Citizens are allowed to use their own experiences and judgments when making selling and purchasing decisions, and this citizen empowerment maximizes the universe of ideas from which improvement and innovation derive.

When governments assign products and services to their citizens, they rely on a small group of people to decide what to offer. This top-down approach is less open, transparent and effective than the decision-making that occurs in markets, and it discourages creativity. This is why most improvements in goods and services emerge from market systems rather than government assignment systems.

Markets allow providers to learn from consumers. When governments dictate to consumers what goods and services they may have, their citizens’ true wants and needs are not fully considered. The voice of the customer is silent. But when consumers are empowered to choose for themselves, providers learn from these choices and adjust accordingly. In markets, this necessity to meet customers’ needs drives innovation and continuous improvement. (more…)

Count newly-elected Florida Rep. Manny Diaz, Jr. among a number of state lawmakers who are public school district employees. But Diaz, an assistant principal in the Miami-Dade public school district, isn’t just a cheerleader for traditional public schools.

He’s also a huge – and very vocal - advocate for school choice.

“We have an evolving student body – different than what it was five years ago,’’ Diaz, a Republican who represents his hometown of Hialeah, said during a recent telephone interview with redefinED. “I do believe we have to look at all the options.’’

Diaz has been appointed to the House Education Committee, as well as the K-12 and Choice & Innovation subcommittees. Among his goals there: to help guide fellow lawmakers and education leaders toward reform that is “student-centered and parent-centered.’’

To that end, Diaz said he fully supports district programs, such as magnet schools; high-quality charter schools; and other nontraditional options, such as tax credit scholarships.

“I think the competition makes our educational choices better,’’ he said. And better can only be defined by results. “I’m big on the accountability side,’’ Diaz said. “It’s a matter of having the political courage to move forward, to take measures already in the law.’’

If a district school isn’t helping students succeed academically, bring in interventions, he said. If a charter school isn’t operating ethically, shut it down.

Diaz also responded to recent news reports in which Gov. Rick Scott called for private schools that accept tax credit scholarships to give those students the same tests as their public school peers. (more…)

Editor's note: Step Up For Students president Doug Tuthill wrote the following letter, which was published this morning in the Tampa Bay Times. It's in response to this Times editorial about testing for students in Florida's tax credit scholarship program and recent comments from Gov. Rick Scott. Some recent news stories have also suggested that testing for scholarship students is limited or nonexistent.

testingFlorida's public education system is so rich with learning options that last year 1.3 million students chose something other than their assigned neighborhood school. So the debate about how best to hold these diverse programs accountable for student progress is important.

Unfortunately, the manner in which the Times questioned testing for one of those programs — a Tax Credit Scholarship for low-income students — was incomplete and misleading. While it is true scholarship students are not required to take the FCAT, that doesn't mean the test most of them take annually, the Stanford Achievement, is irrelevant. This test is considered the gold standard in national exams, and has now been administered for six years with two consistent findings: 1) The students choosing the scholarship were the lowest performers in their district schools; and 2) They are achieving the same test gains in reading and math as students of all incomes nationally.

The expansion of options such as magnet programs, charter schools, virtual schools and scholarships for low-income children strengthens public education. These options all undergo rigorous academic evaluation, and the new national Common Core standards will hopefully make comparative evaluations even easier for parents and the public.

More on testing and voucher kids. According to this Tampa Bay Times story, Gov. Rick Scott will propose that tax-credit scholarship students take the Common Core tests when they replace the FCAT.

Ideologues tend to exaggerate political debate, but Louisiana school superintendent John White reminded us Tuesday that rational policy is the key to integrating vouchers into a robust public education system. The accountability that White introduced, and the Board of Elementary and Secondary Education (BESE) adopted, represents a thoughtful balance of testing, regulation and market forces that ultimately will require vouchers to prove their value.

That's a formula for how private learning options will become mainstream.

Lawmakers have shown themselves to be particularly inept at writing policy framework for vouchers so, in expanding the New Orleans voucher program to the rest of the state, the Louisiana Legislature punted accountability to the bureaucrats. That left White, a former Teach For America administrator and New York City schools executive under chancellor Joel Klein, with a task that requires careful calibration in a volatile environment. (As if to reinforce the rhetorical excess, one BESE board member on Tuesday assured his colleagues they were about to bite into the forbidden fruit of Eden and could be assured that “evil is going to arise.”)

What makes accountability so difficult is that there is still no clear blueprint. Every state with a voucher or tax credit scholarship has a different iteration, and the loudest voices are usually at the extremes – the voucher critics who demand the private schools be held to precisely the same standard as a public school and the voucher advocates who argue that no regulation is necessary because the market will force schools to respond. So the chore is to find the right balance, one with academic and financial oversight that taps into the accountability that follows from a parent who can walk out the door. This is made all the more challenging by the fact that, in most states, the students who receive the scholarship or voucher represent a minority of the enrollment in the private school.

White navigated the academic maze this way: 1) Every voucher student takes the state test; 2) The results of every test are reported on a statewide basis; 3) Any school with at least 40 students taking the test is held accountable; 4) Those schools will be evaluated on a scale similar to that of public schools. If they fail three out of any four years, their students will be given priority to attend other schools. Furthermore, the failing school will not be allowed to take new students and could be dropped from the program.

The rule has been criticized because the accountability portion is projected to capture only about a fourth of the participating schools in the first school year and schools will not be banned after one failing year. But the small number of schools with at least 40 tested students is the very nature of this school landscape. The 5,600 Louisiana students who receive vouchers this fall will not generally be attending schools where every student receives public support. Instead, they will go to private schools with mostly private-paying students, and you can’t reliably measure a school’s fitness based on two or three or a dozen student test scores.

That said, there is nothing sacrosanct about the lines that are drawn in this new Louisiana accountability rule, and they will no doubt be amended and improved over the years. But the rule is a commendable start and one, similar to the approach in Indiana, that makes an important statement about private learning options. They are part of, not in competition with, the public education system, and they need to be properly held to account.
